Natural Gas company budget program denial?

Ok I have my gas heat signed up in my mothers name.Because when I lived with my ex-boyfriend and his mom,around 5 years ago,she ran up a gas bill under my name.My mother doesn't live with me,but she gave me the permission to put it in her name.It has been in her name for 2 years now.I recently tried to get on a program called "CAP".The objective of the program is to help keep heating costs at an amount that is payable on my income.And they denied be based on the fact that it is in her name and she is not a member of the household,eventhough I would otherwise be eligible.They told me that there is no way for me to get on the program as long as the account is under her name,even if she called personally.Is this legal? Im on a tight budget as a single parent,and the gas bill each month is outrageous.I live in the state of Pennsylvania.
